Welcome to HTM System’s terms and conditions of use. These terms and conditions of use apply to and govern your use of this website site (the “Site”). Your use of the Site signifies your agreement to be bound by these terms and conditions. If you do not agree to be bound by these terms and conditions of use, you may not access or otherwise use the Site. HTM System’s Privacy Policy addresses HTM System’s use and release of information collected from your use of the Site.

Ownership : Restrictions

HTM System owns, controls, licenses or has the right to use and provide the Site and all material on the Site, including without limitation, text, images, articles, photographs, illustrations, audio and video clips (collectively the "Content"). HTM System . has created this privacy statement in order to demonstrate our firm commitment to privacy. The following discloses our information gathering and dissemination practices.

We use your IP address to help diagnose problems with our server, and to administer our Web site. Your IP address is used to help identify you and to gather broad demographic information. We use cookies to save a "session id" which is required for you to interact with our site properly. When you close your web browser, this cookie is automatically erased.

Our registration form requires you to supply the following information: name, business name, business address, email address, phone, and fax numbers. This information is used as follows:

  • Your Name and Business name: This information is used to help customize the site and identify you. We will also reference you by this name when sending e-mail. This information is not shared with anyone.
  • E-mail: This information is used to create login name. We also use it to send you information about our company and to keep you informed of any changes to the service or availability problems. We do not share this information with others nor do we send solicitations for goods or services.
  • Business address: Our online system is synced with our internal accounting software which will improve quote turnaround and invoicing time frame. We also use your address to calculate sales taxes. This information is not shared with anyone.

Terms & Conditions.

These terms will govern any orders placed with HTM System ; therefore we encourage you to read these terms prior to placing your order. By submitting an order to HTM System , you (also referred to below as the customer) are hereby agreeing to all the terms and conditions as set forth below. This agreement is in lieu of a written consent, and will be binding by the both the customer and/or their representative(s).

Ordering Process.

USAGE BY MINORS This Site is not intended for or directed to persons who are minors (typically persons under the age of 18, depending on where you live). Because we cannot prohibit minors from accessing, viewing, browsing, visiting or using the Site, we must rely on parents, guardians and those responsible for supervising minors to decide which materials are appropriate for minors to view and/or purchase. By registering with this Site, purchasing products from us or providing us with any information, you represent to us that you are legally permitted to enter into a binding contract (18 years of age or older in most jurisdictions) or, if you are under the legal age of consent, you have the express permission from your parent or guardian and that any information you provide to us is not inaccurate, deceptive or misleading.

EXPORT

The U.S. export control laws regulate the export and re-export of technology originating in the United States. This includes the electronic transmission of information and software to foreign countries and to certain foreign nationals. You agree to abide by these laws and their regulations.

Payment.

Payment is due in full prior to commencement of production. We currently accept Visa, Master Card, American Express and Discover. Credit card surcharge may not be applicable for using your credit card with HTM System . Please be sure to provide your exact billing address and telephone number (the address and phone number your credit card bank has on file for you). Incorrect information may cause a delay in processing your order. Your credit card will be billed upon shipment of your order.

For those orders qualified as custom orders your credit card may be billed in advance to ensure availability of funds.

All International Orders require payment-in-full via bank wire transfer prior to the release of the order. All wire transfer fees are the responsibility of the client.

While we make every attempt to verify prices before charging your credit card, HTM System . shall have the right to refuse or cancel any orders placed on mispriced product whether or not the order has been confirmed and your credit card charged. If your credit card has already been charged for the purchase and your order is canceled,

Confirmation.

You will receive an order confirmation/Sales invoice via email shortly after an order is placed.* For your convenience, an estimated “delivery date” will also appear on the order confirmation form. Please go over the form very carefully to ensure that all the information is accurate. For any corrections or concerns, simply ‘reply’ back to that email, so that we may promptly correct any information prior to processing the order.

Spam / Firewalls.

Check your spam or deleted folders to ensure that these important emails are not blocked due to firewalls or spam filters on your computer.

*We will not be held responsible for failure of any email communication to you either due to incorrectly spelled email addresses, non-working email address or spam filters that prohibit our emails from reaching you.

Online Order – Bank Charges.

When placing an online order, if you press 'SUBMIT' more than once, your card may be charged again. Once you inform us of any such duplicate charges, we will promptly credit the amount back to you, however, we will not accept any responsibility for any subsequent bank fees that may be imposed upon you due to these duplicate charges.

Changing the Order.

For any corrections or changes that may be necessary on a “normal turnaround” order, please reply back to the sales confirmation email immediately. All changes must be made in writing within 2 hours upon receipt of the emailed confirmation. Failure to do so may result in incorrectly printed orders or delays in shipping. Once the order has left the sales department, we will be unable to change the order.

HTM System, HTM System . Logo are trademarks of HTM System . All rights are reserved to HTM System . You agree not to display or use, in any manner, the HTM System . trademarks, without HTM System’s prior permission.

General.

This agreement shall be construed, interpreted and governed by the laws of the State of Florida exclusive of its conflicts of law provisions. This Agreement constitutes the entire agreement between the parties, and supersedes all prior communications, understandings or agreements between the parties. Any waiver or modification of this Agreement shall only be effective if it is in writing and signed by both parties hereto. You shall not use is this service if you are within the United States export regulations and applicable laws and regulations.

SHALL NOT HAVE ANY LIABILITY OR RESPONSIBILITY FOR ANY ERRORS OR OMISSIONS IN THE CONTENT OF THIS SITE, FOR YOUR ACTION OR INACTION IN CONNECTION WITH THIS SITE OR FOR ANY DAMAGE TO YOUR COMPUTER OR DATA OR ANY OTHER DAMAGE YOU MAY INCUR IN CONNECTION WITH THIS SITE. Return & Exchange Procedures.

To request an RMA (Return Merchandise Authorization), send an email This e-mail address is being protected from spambots. You need JavaScript enabled to view it , remember to include your name, date of purchase, reason for return, and order number in your email request. Refunds for credit card purchases will be credited back to the original credit card, only. Refunds for cash or check will be mailed to the original customer.

All returned items must be received in the original packaging, undamaged, with no missing parts, instructions or accessories, and must be in resalable condition. Please include the RMA # on the return shipping label.

Termination.

You agree that HTM System may terminate your membership account and access to the service for any reason. Cause for such termination may include but not be limited to breaches or violations of these Terms of Use or the HTM System . Privacy Policy, a request by you to terminate your Account, discontinuance or material modification to the service, unexpected technical issues or problems, extended periods of inactivity, and requests by law enforcement or other government agencies. Termination of your HTM System . membership account includes elimination of access to the service, deletion of your account information such as your e-mail ID and Password, and deletion of data in your membership account as permitted or required by law. Limitation of Liability.

In all circumstances, HTM System ’ maximum liability is limited to the purchase price of the products sold. HTM System will not, under any circumstance, be held liable for any claim or action that exceeds this liability limit. HTM System will not be liable for any third party claims for damages against the customer, nor for malfunction of product, cause of delays, interruption of service, or loss of business.

Any order placed with or received from HTM System , including but not limited to orders placed via catalog, online, phone or mail, shall be deemed effective acceptance of these terms.

Due to fluctuating manufacturer costs, prices may change without notice.

Claims / Redos

  • Please check your order immediately upon receipt. All claims must be reported within 7 calendar days upon receipt of goods.
  • Claims must be submitted IN WRITING by fax or e-mail with all the necessary information. (Example: wrong item, incomplete order, broken items etc).
  • Attach digital image(s) to your claim depicting the problem at hand.
  • If unable to provide a photograph, you may ship us an "in-hand" sample of the product instead. (The address is under "Contact Us".)
  • Upon receipt of the "visual", we promptly remedy the situation and redo the affected portion of the order if mandated.
  • All redos will ship via our carriers ground. If you require expedited shipping, you will be responsible for those charges.

Shipping.

Estimated Delivery Dates.

Note that delivery dates are only “estimated” and not “guaranteed”
If you opt for “expedited” shipping method for your “normal production” order, only the method of shipping will be guaranteed, however the production timeline is still only “estimated”. Therefore the order may still not reach you in the timeline required.

Shipping.

F.O.B. Shipping Point: Brooksville, Florida.

Under the terms of "FOB shipping point," title of the goods passes to the buyer at the shipping point.

If the order is being shipped via UPS, Fedex, or another one, then once the order is ready to ship out, you will receive an automated email with a “tracking number” from us. Please note that opting for Overnight or Second Day Air does not mean that you will receive your order the next day. Delivery time is based on the time it takes to produce your item PLUS the shipping time*.

*Production time + Shipping time = Delivery time

All shipments leaving our factory are inspected and signed for by the carrier.

Once the order has left the warehouse, HTM System will not accept responsibility for any delays caused by the shipping company. If shipping is delayed on an “expedited” shipping order, ONLY THAT PORTION OF THE SHIPPING CHARGES WILL BE CREDITED BACK BY THE CARRIERS.

HTM System will not be held responsible either in the event the customer is not available for delivery or the customer refuses delivery.

*If a substantially large order requires inside delivery or a residential delivery please specify that information when placing the order. This type of delivery may incur additional charges.

Rush Shipping.

When requesting "Rush Shipping, please note that we reserve the right to rush production (based on overtime/weekend hours) in lieu of using expedited shipping methods, providing that we meet the delivery date.

Freight Claims & Shortage.

All claims for lost or shortage shipments or damaged merchandise in transit, concealed or apparent, caused by a freight carrier, must be filed directly with the freight company. Title to all merchandise passes to the buyer upon consignment to carrier. Owner must initiate freight claim. All products are shipped our selected carriers and always specified. Contact the factory for rush orders.

Important notice for our International Customers – Including Canada:

For orders shipping outside the U.S. - INCLUDING CANADA – local duties and/or taxes may be assessed upon delivery. These fees are not charged by HTM System during checkout; therefore please consult your local customs office to determine these charges. We are not responsible for these duties and/or taxes. Note that delivery dates outside of the U.S. are essentially “estimates”, and in no event will HTM System be liable for any consequential damages arising from delays in delivery.
